These Terms of Service ("Terms") govern your use of vividoptimizer.com and the Vivid Optimizer software (the "Software"), provided by Vivid Software LLC, a California limited liability company ("Vivid," "we," "us"). By purchasing or using the Software, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to purchase from this store.

2. License grant

When you buy a plan, we grant you a personal, non-exclusive, non-transferable license to use the Software for the duration of your plan (24hrs, 7 days, 30 days, lifetime). "Lifetime" means for as long as Vivid continues to offer and support the Software. Each license key is for one user on 1 device(s).

3. Restrictions

You may not:

  • Share, resell, sublicense, or transfer your license key.
  • Copy, modify, reverse engineer, decompile, or create derivative works of the Software.
  • Remove or bypass licensing or security features.
  • Use the Software for any unlawful purpose.

We may revoke a license that violates these Terms without a refund.

4. Your system and backups

The Software changes Windows settings and removes temporary files. Before using it, you're responsible for backing up important data and creating a Windows restore point. Make sure your PC meets the system requirements listed on the product page.

5. No guaranteed results

The Software is designed to help improve PC responsiveness and performance. Results vary by hardware, software, and setup. We don't guarantee any specific improvement, such as frame rate or load times.

6. Payments and refunds

Prices are shown in USD at checkout. Payments are processed through Shopify. Refunds are handled under our Return and Refund Policy.

7. Updates and support

We may release updates, change features, or discontinue parts of the Software. Support is available at contact@vividoptimizer.com.

8. Disclaimer of warranties

Except as stated in our Refund Policy, the Software is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose, to the fullest extent allowed by law.

9. Limitation of liability

To the fullest extent allowed by law, Vivid will not be liable for indirect, incidental, or consequential damages, including data loss or lost profits. Our total liability for any claim is limited to the amount you paid for the license involved.

10. Intellectual property

The Software, website, name, and branding belong to Vivid Software LLC. Buying a license doesn't transfer ownership of any of it.

11. Termination

We may suspend or terminate your license if you violate these Terms. You may stop using the Software at any time.

12. Governing law

These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Long Beach, California.

13. Changes to these Terms

We may update these Terms. Changes apply to purchases made after the update is posted on this page.
